Pictoright issues permission for publication

The Copyright Act stipulates that permission from the creators is required to publish images. They may charge a fee for that permission: after all, image creators must live off the income from their creative work. Apart from a few exceptions, publishers and producers are obliged to trace the creators of the images to ask permission for publication. Pictoright allows them to arrange this properly in advance. There are nearly 100,000 image creators from home and abroad affiliated with us, for whom we issue licenses.

When determining tariffs, the guiding principle is that creators should share in the economic benefits users derive from the use of works. This should result in fair remuneration. Pictoright may decide which forms of use are subject to tariffs. Comparable types of use may be grouped together; there is no obligation to set a separate tariff for every individual situation. However, equal cases must be treated equally. This must be clearly reflected in the tariff scheme and in the criteria on which remunerations are based.

The basic principle is that creators participate in the economic value generated by the use of their work. Whether a user actually makes a profit, or merely intends to do so, does not affect the remuneration. Creators have no control over this. The remuneration must, however, be reasonably proportionate to the value of the use.

Under certain conditions, Pictoright may apply a reduced remuneration, for example in cases of cultural, social, or religious use. In principle, Pictoright does not grant licences free of charge. This follows from its statutory duty to manage the rights and remuneration claims of affiliated creators with due care.
