BeeldAnoniem grants an indemnification if the potential user has met certain conditions. The fee charged for this is managed in an indemnification fund to ensure that, if the rightful copyright holder comes forward, the usage rights can still be settled.

If BeeldAnoniem grants you an indemnity, you pay the fee according to the BeeldAnoniem rates. BeeldAnoniem ensures that you, as a user, are protected against claims from the copyright holder(s), both in and outside the courtroom. The amounts received by BeeldAnoniem for indemnities are reserved for payments to rights holders whom we may still be able to identify. Unpaid amounts remain reserved for potential risks and obligations arising from the indemnities.

The fee structure of BeeldAnoniem is based on that of Pictoright, increased by 25%. BeeldAnoniem reserves the right, if it deems it desirable or necessary, not to grant indemnification or to charge a higher fee. The minimum amount charged per indemnification is €100 excluding VAT.

BeeldAnoniem has no commercial purpose but aims to give users the opportunity to legally publish photos and illustrations without archive images obstructing the commercial opportunities of photographers and illustrators.

The applicant seeks indemnification from BeeldAnoniem against copyright claims related to this publication.

The applicant declares that the creator/copyright holder(s) of the photo(s) or illustration(s) is unknown. Additionally, the applicant affirms that they have made all reasonable efforts to identify them. Furthermore, the applicant will not engage in actions that could harm the interests of the copyright holder(s), such as cropping, altering, or distorting the photo or illustration.

The applicant acknowledges familiarity with BeeldAnoniem's checklist for identifying copyright holder(s) and confirms that they have undertaken all steps outlined in the checklist to determine the identity and/or contact details of the copyright holder(s).

If BeeldAnoniem grants indemnification, the following conditions apply, which the applicant hereby accepts:

This indemnification does not cover claims related to the moral rights of the creator(s) of the photo or illustration. Claims from other parties, such as (heirs of) portrayed individuals or rights holders of depicted works, are not covered by this indemnification. This applies regardless of whether such claims are submitted through the copyright holder(s).
The photo or illustration must be published with the following credit: Name of photographer/illustrator (if known) / BeeldAnoniem.
The applicant agrees to pay the invoiced fee within two weeks of receiving the indemnification, plus an additional 15% administrative fee and 21% VAT.
The applicant commits to immediately referring any claims related to this indemnification to BeeldAnoniem. Failure to comply with this obligation will result in BeeldAnoniem being immediately and irrevocably released from its indemnification obligations.
BeeldAnoniem will also be released from its indemnification obligations if the information provided by the applicant proves to be incorrect or if the applicant otherwise fails to fulfill the obligations of this agreement.

BeeldAnoniem is not a commercial organization. Its goal is to allow users to legally publish photos and illustrations while ensuring that archival images do not undermine the commercial opportunities of photographers and illustrators.
