BeeldAnoniem grants an indemnification if the potential user has met certain conditions. The fee charged for this is managed in an indemnification fund to ensure that, if the rightful copyright holder comes forward, the usage rights can still be settled.

If BeeldAnoniem grants you an indemnity, you pay the fee according to the BeeldAnoniem rates. BeeldAnoniem ensures that you, as a user, are protected against claims from the copyright holder(s), both in and outside the courtroom. The amounts received by BeeldAnoniem for indemnities are reserved for payments to rights holders whom we may still be able to identify. Unpaid amounts remain reserved for potential risks and obligations arising from the indemnities.

BeeldAnoniem has no commercial purpose but aims to give users the opportunity to legally publish photos and illustrations without archive images obstructing the commercial opportunities of photographers and illustrators.

What does BeeldAnoniem do?

If you want to publish a photo or illustration, you need permission from the copyright holder. If you are unable to trace the name and address of the rights holder, BeeldAnoniem can assist you. In exchange for a reasonable fee, we provide you with an indemnification, allowing you to publish the photo or illustration. We also take on the responsibility of searching for the photographer or illustrator on your behalf. If the photographer contacts you regarding the publication, you can refer them to our foundation.

BeeldAnoniem has an extensive database of contacts. If we are able to trace the name and address of the photographer or illustrator, we will provide you with this information so you can request permission for publication in the usual way.

If it is not possible to retrieve the necessary details of the rights holder, you can submit a request for indemnification against copyright claims. If BeeldAnoniem grants you this indemnification, you will pay the standard publication fees plus a 15% administrative surcharge. By doing so, BeeldAnoniem commits to indemnifying you, the user, both in and out of court against any claims from copyright holders. The collected fees are reserved for payments to rights holders if they are identified. Any unpaid funds remain allocated to cover the risks and obligations arising from the indemnifications.

BeeldAnoniem is a non-commercial initiative aimed at enabling users to legally publish photos without archival images competing with the general market for photographers.

History

Stichting FotoAnoniem was founded in 1984. Its first chairman was the legendary photographer Sem Presser, who also played a key role in establishing the photographers’ association GKf, the Dutch Association of Photojournalists (NVF), the Zilveren Camera awards, and the copyright organization Burafo.

In 2021, after extensive consultations with the Association of Dutch Designers (BNO), FotoAnoniem expanded its scope and became Stichting BeeldAnoniem. The foundation now supports not only orphaned photographs but also works by designers and illustrators whose creators cannot be traced.

BeeldAnoniem follows a structured pricing list for its services, which is regularly updated in collaboration with creators’ organizations. For all creators, the enforcement of copyright remains a top priority. In this regard, BeeldAnoniem plays a small but crucial role. After all, its activities serve as a powerful reminder that images cannot be used freely—not when the creator is known, and certainly not when the creator is unknown.
